(3) Carvana was breaking rules and laws in numerous markets due to the aforementioned;
(4) Carvana put its ability to continue operating and/or grow its business in current markets at risk because of the aforementioned;
(5) The aforementioned put Carvana at a higher risk of official scrutiny and action;
(6) Carvana was in talks with state and local officials about the aforementioned business strategies and problems;
(7) In various states and counties, including Arizona, Illinois, Pennsylvania, Michigan, and North Carolina, Carvana was facing impending and ongoing regulatory measures, such as license suspensions, business closure, and probation; and
(8) Due to this, Defendants’ claims about Carvana’s operations, prospects, and business were materially false and misleading at all pertinent times, and/or lacked a reasonable basis.
